1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use ofhopui.com and its content (together, the “Site”), operated byHopui (“we”, “us”, “our”). By accessing the Site you agree to be bound by these Terms and by ourPrivacy Policy. If you do not agree, please do not use the Site.

You must be at least 16 years old, or the age of digital majority where you live, to use the Site.

2. What this Site is — and is not

The Site publishes editorial reviews, rankings, and buying guides for consumer products. Everything here is opinion and general information. It is offered in good faith and based on our own testing, but it is not professional advice of any kind.

In particular, nothing on the Site is medical advice. Massage chairs and similar equipment are consumer products, not treatments. Content on this Site is not intended to diagnose, treat, cure, or prevent any condition. Speak to a qualified clinician before using this kind of equipment if you are pregnant, have osteoporosis, a pacemaker or other implanted device, blood clots, recent surgery, a spinal condition, or any acute injury. Never disregard or delay professional medical advice because of something you read here.

3. Affiliate relationships

The Site is funded by affiliate commissions. Many outbound product links are affiliate links, meaning we may earn a commission if you purchase through them, at no additional cost to you. This is disclosed on every page carrying such links and explained in full in ourAffiliate Disclosure.

Commission does not determine our rankings. However, you should read our content with the commercial relationship in mind and make your own assessment, as you would with any publication funded by advertising or commerce.

4. Accuracy, prices, and availability

Product specifications, prices, and availability shown on the Site are indicative, are gathered at a point in time, and change frequently and without notice. The price and specification shown by the retailer at the moment of purchase is the one that applies. We make no representation that any information on the Site is current, complete, or free of error, and we are not responsible for pricing or descriptive errors, whether ours or a retailer's.

We revise content periodically but are under no obligation to update any particular page.

5. Transactions are with the retailer, not with us

We do not sell products. When you follow a link and buy something, your contract is with that retailer or manufacturer. All questions of payment, delivery, installation, returns, refunds, guarantees, and warranty service are between you and them, under their terms. We are not a party to that transaction and accept no liability arising from it.

6. Intellectual property

All content on the Site — text, reviews, scores, photography, illustrations, layout, code, and the Hopui name and marks — is owned byHopui or its licensors and is protected by copyright and trade mark law.

You may:

• View, download, and print pages for your own personal, non-commercial use;
• Quote short extracts with clear attribution and a link back to the page quoted.

You may not, without our prior written permission:

• Republish, syndicate, or redistribute our content in whole or in substantial part;
• Use it to train machine learning models or build a derivative dataset;
• Scrape the Site systematically or by automated means;
• Use our name or marks in a way that suggests endorsement or affiliation;
• Remove or obscure any copyright or attribution notice.

Third-party trade marks and product names appear on the Site for identification only. Their use does not imply any endorsement of, or affiliation with, Hopui.

7. Acceptable use

You agree not to:

• Use the Site unlawfully or for any unlawful purpose;
• Interfere with the Site's operation, security, or availability, including by attempting unauthorised access or introducing malicious code;
• Place unreasonable load on our infrastructure through automated requests;
• Misrepresent your affiliation with us, or impersonate any person or entity.

8. Third-party links

The Site links to websites we do not control. Those links are provided for convenience and do not constitute endorsement. We are not responsible for the content, policies, or practices of any third-party site, and you access them at your own risk.

9. Disclaimer of warranties

The Site and its content are provided “as is” and “as available”, without warranty of any kind, express or implied. To the fullest extent permitted by law we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Hopui and its officers, employees, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site or reliance on its content — including any purchase decision made on the basis of a review published here.

Where liability cannot lawfully be excluded, our total aggregate liability to you is limited to one hundred pounds sterling (£100).

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. If you are a consumer, you retain all statutory rights that cannot be waived by agreement.

11. Indemnity

You agree to indemnify and hold harmless Hopui from any claim, demand, loss, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

12. Changes to the Site and to these Terms

We may modify, suspend, or discontinue any part of the Site at any time. We may also revise these Terms; the revised version takes effect when posted, and the “last updated” date at the top will change. Continuing to use the Site after that point means you accept the revised Terms. If you do not, stop using the Site.

13. Governing law and disputes

These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the courts located there, except that if you are a consumer resident elsewhere, you keep the benefit of any mandatory protections and the right to bring proceedings in your own country of residence.

Before starting formal proceedings, please email us — most issues are quicker to fix than to litigate.

14. General

If any provision of these Terms is held unenforceable, the remainder stays in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy andAffiliate Disclosure, are the entire agreement between you and us regarding the Site.
